Welcome to Kat in the Studio (“we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your use of our website https://www.katinthestudio.ca (“the Site”) and any purchases made through it.

By accessing or purchasing from our Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.

1. Products and Services

​

Kat in the Studio offers original artwork, fine art prints, and digital illustrations for sale.
We strive to represent all items accurately; however, colours and textures may appear slightly different depending on screen settings or materials.

We reserve the right to modify or discontinue any product at any time without notice.

2. Orders and Payments
 

All orders placed through the Site are subject to acceptance and availability.
Payments are securely processed through Wix Payments, PayPal, or Alipay.
We do not store payment card information on our servers.

Prices are displayed in your local currency for convenience through our Currency Converter, but all transactions are ultimately processed in Canadian Dollars (CAD) unless otherwise stated.

We reserve the right to refuse or cancel any order, for example, if an item is out of stock, if payment is not authorized, or in the event of suspected fraud.

3. Shipping and Delivery

​

We ship artwork from Calgary, Alberta, Canada.
Shipping costs and estimated delivery times are shown during checkout.
International customers are responsible for any customs duties, taxes, or import fees.
Once an order has shipped, we are not liable for delivery delays caused by carriers or customs processes.

4. Returns and Refunds

​

Because each artwork is individually created, all sales of original artwork are final.
Prints and digital products are non-refundable once delivered, except in the case of damage or defect.

If you receive a damaged item, please contact katinthestudio@gmail.com within 7 days of delivery with your order number and photos of the issue. We will arrange a replacement or refund if applicable.

5. Custom Commissions

​

We offer custom artwork commissions through our Commissions Page.

• A 50% non-refundable deposit is required to confirm a commission and secure your place in our schedule.

• The remaining 50% is due upon completion of the artwork, prior to delivery or shipment.

• Commissioned artwork will not be shipped or released until full payment has been received.

• Deposits are non-refundable once work has begun.

• Minor adjustments may be accommodated within reason, but major revisions or changes in concept after work has begun may incur additional charges.
   

We reserve the right to decline any commission request at our discretion.

6. Digital Downloads

​

Digital files, colouring pages, and other downloadable content are for personal use only and may not be resold, redistributed, or shared.

Once a digital file has been purchased and delivered, no refunds or exchanges are offered.
Please ensure that your device is capable of opening and storing the digital file before completing your purchase.

7. Intellectual Property and Copyright

​

All artwork, images, designs, and written content on this Site are the exclusive property of Kat in the Studio and are protected by copyright and intellectual property laws.

You may not:

• Copy, reproduce, modify, or distribute any content without written permission

• Use artwork for commercial purposes, resale, or reproduction

• Claim ownership of artwork or digital products purchased

Purchasing an original artwork, print, or digital file does not transfer copyright ownership.
We reserve the right to reproduce and display images of original artwork for portfolio, exhibition, or marketing purposes unless otherwise agreed upon in writing.

Unauthorized use of Kat in the Studio’s artwork or images may result in legal action.

8. Third-Party Services

​

Our Site uses third-party services such as Currency Converter, PayPal, and Alipay to process transactions and improve user experience.
By using these features, you agree to their respective terms and privacy policies.
We are not responsible for any errors, outages, or issues caused by these third-party providers.

9. Limitation of Liability

To the fullest extent permitted by law, Kat in the Studio shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or from purchasing products.
Our total liability for any claim shall not exceed the amount you paid for the product in question.
